Applying for the Notice on Foreigner's Work Permit of the People’s Republic of China
Scope of Application
1. The applicant with qualified professional skills or knowledge shall have a certain clearly-defined employer in China and shall be at least 18 years old in good health and without a criminal record.

4. Foreign professionals shall refer to those meeting the guideline catalog and job requirements for foreigners working in China, who are urgently needed for economic and social development, have a bachelor's degree or above and related working experience of two years or more, and are under 60 years old. Restrictions on age, education or work experience may be appropriately relaxed for those who are really in need and meet the criteria of innovative and entrepreneurial talents, professional and skilled talents, outstanding foreign graduates, foreign professionals satisfying the criteria of the score system and who are in the implementation of inter-governmental arrangements or agreements. 5. Applicable to Clauses 2, 3, 4 and 5 for professional foreign talents (Type B) in Classification Criteria for Foreigners Working in China.
Required Materials
1. The application form for permission for foreigners to work in China shall be filled out online and then printed out, signed by the applicant (photocopy or fax), and uploaded to the system with the official seal of the employer or the official seal of the authorized department of the employer. Original (1 paper/electronic copy). Note: The official seal of the employer shall include the official name seal, as well as the official seal of the foreign affairs, personnel agency and labor contract business that has been registered in the authorization record of the system.
2. The certificate of work experience shall be issued by the former employer of the applicant to prove the work experience related to the current employment, including the position, working hours or projects done, and shall be affixed with the official seal of the former employer or signed by the person in charge, with the valid contact phone number or email of the contact person. 3. Certificate of highest degree (diploma) or related approval document, certificate of professional qualification certifying highest degree (diploma), if obtained overseas, shall be accredited by the Chinese diplomatic or consular missions abroad or by the diplomatic or consular missions of the country in which the degree (academic degree) was obtained or by the academic qualification recognition institution in China. If the highest degree (academic degree) certificate is obtained in Hong Kong, Macao and Taiwan, it shall be certified by the academic degree certification body in China or notarized by a notary public in China. If the highest degree (academic) certificate was obtained in the Chinese Mainland, only the original academic (degree) certificate is required. If the laws and regulations of China stipulate that the competent department of the industry shall give pre-approval or shall have the corresponding occupational qualification for admission in China, the approval instrument of the competent department of the industry or proof of occupational qualification shall also be provided. 4. The certificate of no criminal record shall be issued by the police, security or court authorities of the applicant's country of nationality or the habitual residence and shall be certified by the embassy or consulate of the People's Republic of China or the foreign ambassador or consul in China. A certificate of no criminal record issued in the Hong Kong and Macao Special Administrative Regions and Taiwan shall be notarized by a notary public in the region where it is issued. The place of habitual residence is the country or region where the applicant last resided continuously for more than one year outside his/her country of nationality, excluding in China. The certificate of no criminal record shall be issued within six months. Original (1 paper/electronic copy). Note: A sworn statement of no criminal record merely for the purpose of declaring the no criminality of the person shall not be accepted. Non-sworn certificate of no criminal record issued by diplomatic authorities (including foreign embassies and consulates in China) may be accepted directly without further certification.
5. The physical examination certificate shall be issued by the Chinese inspection and quarantine agency to verify the medical examination record or health examination certificate of the overseas personnel, or by the overseas health and medical institution recognized by the Chinese inspection and quarantine agency, all of which shall be issued within six months. Original (1 paper/electronic copy). If such certificate is not available, the employer may issue and submit a health commitment. Note: The list of overseas health care institutions recognized by Chinese inspection and quarantine agency are available on the website of local embassies and consulates abroad. If a commitment system is adopted prior to entry into China, when applying for the " Foreigner's Work Permit in the People's Republic of China" upon entry into the country, a certificate of verification of the physical examination record of the foreigner or a certificate of health examination issued by the inspection and quarantine institution in China shall be additionally submitted.
6. Contract of employment or proof of employment (including letter of assignment from a transnational corporation). The contract shall be provided in Chinese and shall be signed by the applicant and affixed with the official seal of the employer, and shall not be altered. If the employment contract cannot be provided before entry into China and the employer is recognized by the licensing agency as a typical employer of good faith and has no bad credit record for three consecutive years, the employer can provide proof of employment and submit the employment contract after entry into China when applying for the Foreigner's Work Permit in China, and the requisite contents shall be consistent; otherwise, the employer shall apply for such permit again, except for salary increase or job (position) promotion. Note: The employment contract or certificate of employment (including the letter of assignment from a multinational company) shall include the required information about the workplace, job content, salary, working hours, position in China as well as the stamp page (signature). The certificate of employment shall apply to personnel engaged in the implementation of agreements or arrangements between/among governments, international organizations, chief representatives and representatives of various types of representative offices in China as well as offshore contractual service providers. The letter of assignment shall apply when the headquarters or regional headquarters of a multinational corporation dispatches senior management and professional and technical personnel, such as managers, from abroad to work in its domestic subsidiaries or branches, and shall be issued by the headquarters or regional headquarters of such multinational corporation. Should the certificate of employment (including the letter of assignment) lack the necessary contents, a separate certificate shall be issued as a supplement (with the official seal). In case of assignment of senior management personnel such as managers and professional technicians by the headquarters of a multinational corporation in China to a domestic subsidiary or branch office, a letter of assignment and an employment contract signed with the headquarters of the multinational corporation in China shall be submitted.
7. The information page of the applicant's passport or international travel document. Original (1 electronic copy). Note: The remaining validity of the passport shall not be less than six months.
8. Frontal bareheaded photo of the applicant taken within 6 months: Recent bareheaded digital photo, white background, no borders, complete facial features, clear image, without spots, blemishes or printing ink defects. JPG format, size between 40K-120k bytes, not less than 354 (W) × 472 (H) pixels, not more than 420 (W)×560 (H) pixels, 24 true colors. Original (1 electronic copy). Note: Ornaments such as hats or headscarves are not recommended, and if it is necessary for religious reasons, please ensure that they do not obscure the entire face of the applicant.
9. Supporting documents for accompanying family members: Information page of the passport (or international travel document) of the accompanying family member, proof of family relationship (spouse - marriage certificate, child - birth or adoption certificate of the child, parent or spouse's parent - birth certificate of the applicant or marriage certificate or notarized certificate), physical examination report (for a family member over 18 years of age); and related electronic photo. Original (1 paper/electronic copy). Note: Accompanying family members shall include spouse, children under 18 years of age, parents and parents of spouse (except family members of Chinese nationality).
10. Other materials.
Material Standards
1. All original paper documents and Chinese translations shall be uploaded electronically into the application system.
2. All supporting documents that are not in Chinese shall be translated into Chinese and affixed with the official seal of the employer (except for passport or international travel document).
3. All original documents shall be submitted to the reception window for verification, of which employment contracts, proof of kinship, birth certificates, and materials certified on the original of degree certificates can be verified on site and then photocopies can be submitted (with official seals).
4. After passing the online pre-qualification, please make an appointment in the system, and bring the appointment certificate and related materials to the site for further procedures.
Notes:
1. All supporting documents that are not in Chinese shall be translated into Chinese and affixed with the official seal of the employer, except for passport or international travel document. 1. Should the accepting or deciding body consider that the translations are seriously inconsistent with the originals, it may request the employer to provide them again.
2. All original paper documents and the Chinese translations shall be accompanied by the color information attached to the original documents.
3. In principle, applicants who have already obtained a Foreigner's Work Permit are not required to submit their highest degree (diploma) when they apply again (the system history is available). If the position applied for is the same as the original work permit approved for employment, supporting documents of work experience are not required. If there is a record of our city** within the last 3 years, in principle, the degree certification may be exempted by submitting a copy of the original work document/employment card/expert card affixed with the official or authorized seal of the employer.
4. In case of a change of nationality, a new application shall be made for a foreigner's work permit in China.

6. An overseas contract service provider shall refer to an employee of a foreign enterprise that does not have a commercial presence (i.e., a legal entity) in China but engages in substantial commercial activities outside China who enters China to provide temporary services for the purpose of fulfilling a service contract obtained by the employer from China, and the remuneration for such period shall be paid by the overseas employer. The service provider shall have the academic and professional technical qualifications appropriate to the service so provided. The number of service providers shall be based on the size of the tasks to be performed under the contract. When applying for a work permit in China, in addition to all the above-mentioned documents, the foreign contract provider shall submit the service contract obtained in China (which shall include the subjects of both parties to the contract, the place of work, the service content of the contract, the applicant's position and work content, the duration of work in China, and the signature page).
7. Foreign language teaching staff In principle, foreign language teaching staff shall be engaged in the teaching of their mother tongue, have a university degree or higher and have at least two years' experience in language teaching. The work experience requirement may be exempted for those who have obtained a bachelor's degree or higher in education, language or teacher training, or who have obtained a teaching certificate in their country of residence or a certificate in teaching an international language that meets the requirements (the certificate shall be certified).
8. If the laws and regulations of China stipulate that the competent department of the industry shall give pre-approval or shall have the corresponding occupational qualification for admission in China, the approval instrument of the competent department of the industry or proof of occupational qualification shall also be provided.
